R -22 -07 <br />A RESOLUTION APPROVING A MEMORANDUM OF AGREEMENT WITH THE <br />CITY OF CHESAPEAKE AUTHORIZING MUTUAL LIMITED OCCUPANCY OF <br />RIGHTS -OF -WAY AND A LIMITED FIBER STRAND EXCHANGE. <br />WHEREAS, the City has designed and constructed a fiber network ring; and <br />WHEREAS, a small portion of the City's ring has been constructed within the City of <br />Chesapeake's right -of -way; and <br />WHEREAS, the City of Chesapeake also intends to construct its own municipal fiber <br />network ring; and <br />WHEREAS, a small portion of the Chesapeake ring will be constructed within the City of <br />Portsmouth's right -of -way; and <br />WHEREAS, the two Cities also intend to better coordinate public safety resources by <br />connecting their public safety buildings through the fiber network rings, which can be <br />accomplished through allowing each other access to fiber strands at specific locations; and <br />WHEREAS, to accomplish the foregoing purposes the Cities have negotiated a <br />Memorandum of Agreement; <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia that it hereby approves and authorizes the City Manager to execute and deliver a <br />Memorandum of Agreement with the City of Chesapeake in substantially the form attached hereto <br />as Exhibit A. <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held on March <br />22 2022. <br />Teste: <br />City Clerk <br />
