2410 Turnpike Road (Tax Parcel 0175 -0190) <br />2414 Turnpike Road (Tax Parcel 0175 -02000 <br />2416 Turnpike Road (Tax Parcel 0175 -0210) <br />ALL THOSE certain lots, pieces or parcels of land, lying, being <br />and situate in the City of Portsmouth, Virginia, and known, <br />numbered and designated as Lot Nos. 9, 10 and 11 on the plat of <br />Barrett and Syer, duly recorded in the Clerk's Office of the Circuit <br />Court of the City of Chesapeake, Virginia, in Map Book 3, page <br />42, to which said plat reference is hereby made for a more <br />complete description of said property, the same fronting ninety <br />(90') feet, more or less, on the south side of Turnpike Road. <br />IT BEING a portion of the property conveyed by Quitclaim Deed <br />from the Commonwealth of Virginia to the City of Portsmouth, <br />Virginia dated August 22, 2018 and recorded in the Clerk's Office <br />of the Circuit Court for the City of Portsmouth, Virginia as <br />Instrument Number 190001533. <br />6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The development shall be in substantial compliance and conformity with <br />the concept plan entitled "Rezoning Exhibit LBC Transportation, LLC" <br />prepared by Hoggard -Eure Associates, P.C. and dated October 18, 2022, <br />except where modifications may be required due to improvements <br />recommended by the Traffic Impact Analysis described below or to <br />comply with applicable local, state, or federal codes or regulations. <br />(b) The approved use shall be designed and operated in accordance with the <br />use - specific standards for shipping container /chassis storage yard uses <br />outlined in Section 40.2- 217(H)(3)(b) of the Zoning Ordinance. <br />(c) A Traffic Impact Analysis satisfying and in accordance with the <br />requirements of Section 40.2 -545 of the Zoning Ordinance shall be <br />prepared and submitted as part of the Site Plan Review submission for the <br />development. Furthermore, the owner /operator of the development, at no <br />cost to the City, shall comply with the recommendations included in the <br />Traffic Impact Analysis as approved by the City Engineer, whether on -site <br />or off -site. <br />(d) Prior to Site Plan Review approval, the owner /operator of the development <br />shall cause preparation of a Minor Subdivision plat combining the parcels <br />subject to this use permit into one parcel in accordance with the standards <br />and requirements set forth in Chapter 33.1 of the City Code and, after <br />
