b. Before the initiation of any excavation, the Contractor shall locate all existing <br />utilities, culverts, and other structures. Work shall be coordinated with affected utility <br />companies. Prior to excavation, the Contractor shall contact MISS UTILITY at 811 and <br />comply with all MISS UTILITY requirements. <br />c. Each Party shall establish membership in the local MISS UTILITY program and <br />perform all cable and conduit locate activities required to protect the respective conduits. <br />4. NON - ROUTINE MAINTENANCE <br />All maintenance other than routine maintenance as described in Section 3, above, shall be deemed <br />to be non - routine maintenance. Each Party shall provide 24x7 real -time contact information to the <br />other Party for the purpose of reporting service affecting conditions to that Party. When reporting <br />a service affecting condition, each Party shall provide the following information to the other Party: <br />a. Type /nature of problem; <br />b. Location of the problem; and <br />C. Any other pertinent information that may help in identifying and resolving the <br />problem in an expedient manner and to ensure the appropriate response is initiated. <br />When each Party identifies or is notified of a problem via either system alarm or the other Party, <br />that Party will initiate repair /response activities as appropriate and necessary for the type of <br />problem being reported. <br />The repairing Party shall have its first maintenance representative on -site within one (1) hour after <br />the time it becomes aware of a service affecting condition (whether same occurs within normal <br />business hours or after - hours, weekend or holiday), unless delayed by circumstances beyond its <br />reasonable control. The repairing Party will provide effective follow -up information to the other <br />Party on the maintenance action until the issue has been resolved. In the event that the repairing <br />Party dispatches personnel for a conduit breach, fiber outage or other problem caused by the other <br />Party's equipment or personnel, the repairing Party will invoice and the other Party agrees to pay <br />the repairing Party charges for time and travel associated with such dispatch. <br />5. REPAIR AND RESTORATION <br />When undertaking repairs of major conduit and/or Fiber failures, the repairing Party shall work to <br />restore the respective conduit as quickly as possible. Immediately upon arriving on the site of the <br />damage, the repairing Party will determine the course of action to be taken to restore the conduit <br />and/or Fiber and begin restoration efforts. The repairing Party shall use reasonable efforts to effect <br />repairs of major failures within four (4) hours after the maintenance representative arrives at the <br />site of the problem. Such repairs may be temporary. <br />Within one (1) business day after completing any temporary repair or restoration, the repairing <br />Party shall commence planning permanent repair. The repairing Party shall notify the other Party <br />of its permanent repair plans and implement such repairs within an appropriate time thereafter. <br />
