Building Code or the Virginia Statewide Fire Prevention Code, as applicable, and the city <br />code regarding appeals the Virginia Uniform Statewide Building Code or the Virginia <br />Statewide Fire Prevention Code shall control. <br />2. Article III of Chapter 13 of the Code of the City of Portsmouth, Virginia (2006) is <br />amended by adding a new Section 13 -90 as follows: <br />Sec. 13 -190. — Appeals. <br />Any determination by the department of fire, rescue and emergency services <br />under this chapter that is appealable under the Virginia Statewide Fire Prevention Code <br />shall be appealed to the local board of building code appeals established under section 7- <br />171 of the city code. Any appeals under this section shall be subject to all procedures <br />governing appeals set forth in the Virginia Statewide Fire Prevention Code and chapter 7 <br />of the city code, including payment of an appeal fee. <br />3. Division 1 of Article II of Chapter 17 of the Code of the City of Portsmouth, <br />Virginia (2006) is amended by adding a new Section 17 -35 as follows: <br />Sec. 17 -35. — Anneals. <br />Any determination by the department of permits and inspections or the code <br />official under this chapter that is appealable under the Virginia Maintenance Code shall <br />be appealed to the local board of building code appeals established under section 7 -171 of <br />the city code Any appeals under this Section shall be subject to all procedures governing <br />appeals set forth in the Virginia Uniform Statewide Building Code and chanter 7 of the <br />city code, including payment of an appeal fee. <br />4. Division 2 of Article II of Chapter 17 of the Code of the City of Portsmouth, <br />Virginia (2006) is deleted in its entirety and Division 2 shall be reserved as follows: <br />DIVISION 2. - <br />RESERVED <br />
