Except as expressly shown on this Exhibit A, the Code <br />of the City of Portsmouth, Virginia is not otherwise amended. <br />L Article III of Chapter 7 of the Code of the City of Portsmouth, Virginia (2006) is <br />amended by adding a new Division Three titled "Appeals" as follows: <br />DIVISION 3. - APPEALS <br />Sec 7 -171. — Local board of building code anneals. <br />There is created a local board of building code appeals pursuant to the Virginia <br />Uniform Statewide Building Code adopted by reference in section 7 -96 of the city code <br />(including without limitation the Virginia Maintenance Code adopted by reference in <br />section 17 -24) and the Virginia Statewide Fire Prevention Code adopted by reference in <br />section 13 -81 The board shall be established and shall conduct and consider appeals of <br />determinations by the department of permits and inspections, the building official, and /or <br />the department of fire rescue and emergency services that are appealable under, and in <br />accordance with, the standards and requirements set forth in the Virginia Uniform <br />Statewide Building Code or the Virginia Statewide Fire Prevention Code, as applicable. <br />The board shall consist of five regular members and a maximum of two alternates <br />appointed by, and serving at the pleasure of city council. Each member and alternate <br />shall have a term of four years and may be appointed to one or more successive <br />additional terms. Failure to submit an application for appeal to the local board of <br />building code appeals within such timeframe as may be required under the Virginia <br />Uniform Statewide Building Code or the Virginia Statewide Fire Prevention Code, as <br />applicable (or if no timeframe is set forth in the VUSBC or VSFPC, then within thirty <br />calendar days of receipt of the decision being appealed) shall constitute acceptance of the <br />determination by the department of permits and inspections, the building official, or the <br />department of fire, rescue and emergency services. <br />Sec. 7 -172. — Jurisdiction. <br />Except where state law provides otherwise, the local board of building code appeals <br />shall have jurisdiction of all appeals of determinations under chapter 7 or chanter 17 of <br />the city code that are authorized under the Virginia Uniform Statewide Building Code, <br />including Part I (Virginia Construction Code), Part II (Virginia Existing Building Code) <br />and Part III (Virginia Maintenance Code). Except where state law provides otherwise, <br />the local board of building code appeals shall also have jurisdiction of determinations <br />under chapter 13 of the city code that are authorized under the Virginia Statewide Fire <br />Prevention Code.
