R -21 -15 <br />A RESOLUTION AUTHORIZING THE CONTINUED LEASING OF FORMER <br />RAILROARD RIGHT -OF -WAY LOCATED IN SUFFOLK TO THE CITY OF <br />SUFFOLK FOR USE AS A RECREATIONAL TRAIL. <br />WHEREAS, by Resolution R -06 -38 adopted on July 11, 2006, City Council authorized <br />the City Manager to execute a lease with the City of Suffolk for the use of certain former railroad <br />right -of -way located in Suffolk as a recreational trail; and <br />WHEREAS, the lease was duly executed; and <br />WHEREAS, the lease expires on June 30, 2021 and Suffolk has requested that the City <br />enter into a new lease agreement so that it can continue to use the property as a recreational trail; <br />and <br />WHEREAS, a new lease has been drafted containing substantially the same terms as the <br />original lease; <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia, that the City Manager be, and she hereby is, authorized to enter into a Lease Agreement <br />in substantially the form attached hereto as Exhibit A for the purpose of allowing the City of <br />Suffolk to a lease portion of the former Norfolk Southern Railroad Right -of -Way from Moore <br />Avenue to Suburban Drive in Suffolk for use as a recreational trail. <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held on <br />June 22, 2021. <br />Teste: <br />City Clerk <br />
