R -20 -20 <br />A RESOLUTION REQUESTING AND PETITIONING THAT A REFERENDUM BE <br />HELD ON THE QUESTION OF WHETHER CASINO GAMING SHALL BE <br />PERMITTED WITHIN THE CITY OF PORTSMOUTH. <br />WHEREAS, by Ordinance 2020 -47 adopted on May 26, 2020 City Council selected Rush <br />Street Gaming LLC and Portsmouth Gaming Holdings, LLC (collectively, "Developer ") as the <br />City's "preferred casino gaming operator" within the meaning of Sections 58.1 -4100 and 58.1- <br />4107 of the Virginia Code; and <br />WHEREAS, the City promptly submitted the Developer as its preferred casino gaming <br />operator to the Virginia Lottery Department ( "Lottery "); and <br />WHEREAS, Lottery has successfully completed its preliminary review of the Developer <br />and, in accordance with Subsection 58.1- 4107(F) of the Virginia Code, has certified its approval <br />for the City of Portsmouth to proceed to the casino gaming referendum required by Virginia Code <br />Section 58.1 -4123; and <br />WHEREAS, Subsection 58.1- 4123(B) of the Virginia Code provides that -[t]he governing <br />body... [of an] eligible host city shall petition the court, by resolution, asking that a referendum be <br />held on the question of whether casino gaming shall be permitted within the city "; <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia that it hereby petitions the Circuit Court for the City of Portsmouth, Virginia to request <br />that a referendum be held on the question of whether casino gaming shall be permitted within the <br />city of Portsmouth; and <br />BE IT FURTHER RESOLVED that it requests that the said referendum be held on <br />November 3, 2020, in accordance with Section 6 of Acts of Assembly Chapter 1197, approved on <br />April 4, 2020; and <br />BE IT FURTHER RESOLVED that the City Attorney and his designees are authorized <br />and directed to file the appropriate Petition and pleadings with the Portsmouth Circuit Court in <br />furtherance of the purpose of this Resolution; and <br />BE IT FURTHER RESOLVED that the City Manager, City Attorney, and their designees <br />are authorized to take such further actions as are necessary or desirable in furtherance of the <br />purpose of this Resolution; and <br />BE IT FURTHER RESOLVED that this Resolution shall take effect on the date of <br />adoption. <br />ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held on July <br />16, 2020. <br />Teste: <br />City Clerk <br />
