(f) The contractor shall be responsible for all necessary permits and approvals for <br />construction of the water mains. <br />(g) Norfolk will invite Portsmouth to all scheduled construction meetings during <br />the construction of the water mains. <br />(h) Portsmouth shall be apprised of any field activities that result in a significant <br />change to the design and shall have the right to review and approve all change orders related to <br />the design or materials for the Portsmouth water line, said review to be timely and said approval <br />not to be unreasonably withheld. <br />(i) Norfolk shall have the sole authority to direct the contractor to assure that the <br />water mains are constructed in accordance with the approved plans and specifications. <br />Portsmouth shall own, operate and maintain the thirty (30) inch finished water line at <br />Portsmouth's sole cost and expense. <br />10. PAYMENT TO CONTRACTORS: All payments to contractors shall be <br />made by Norfolk upon presentation of appropriate invoices for work performed. Portsmouth <br />shall reimburse Norfolk for Portsmouth's share of the Project costs within thirty (30) days of <br />receipt of invoices showing the Non - Reimbursable Costs paid by Norfolk. <br />11. CORRECTION OF CONSTRUCTION DEFECTS: Norfolk will require the <br />construction contractor to provide a performance and payment bond for the full amount of the <br />construction of both the NRWM and the NFWM. The construction contract shall also provide for <br />a warranty of the work against construction defects and shall require the contractor to correct <br />defects that are reported by Norfolk and /or Portsmouth within two years of the acceptance of the <br />water mains. The construction contract shall also provide that Portsmouth shall be a third party <br />9 <br />
