ORDINAa 2020 -06 <br />ZONING AMENDMENT ORDINANCE Z -19 -07 <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br />1. That the portion of the zoning map attached to and made a part of the City <br />of Portsmouth Zoning Ordinance, which now zones as SD -K, Special District <br />(Conditional) the property described in Petition for Zoning Amendment Number Z -19- <br />07, is hereby amended and changed so as to show said property zoned as IN-K, Industrial <br />(Conditional), and that said property is hereby zoned as IN -K, Industrial (Conditional). <br />2. That the property affected by this ordinance by being zoned from SD -K, <br />Special District (Conditional) to IN -K, Industrial (Conditional) is furthermore described <br />as follows: <br />Z -19 -07 <br />176 Lincoln Street (Tax Parcel 0011 -1330) <br />0 Gosport Road (Tax Parcel 0011 -1331) <br />ALL THAT certain lot, piece or parcel of land, situated, lying and <br />being in the City of Portsmouth, Virginia, and designated as <br />"PARCEL 1" on the plat entitled "SUBDIVISION OF HARBOR <br />CENTER SECTION ONE PORTSMOUTH, VIRGINIA ", dated <br />August 27, 2000, and duly recorded in the Clerk's Office of the <br />Circuit Court of the City of Portsmouth, Virginia in Map Book 18, <br />at Pages 138 -139. <br />IT BEING that certain property conveyed to Waterfront <br />Acquisition, LLC by Special Warranty Deed from Ocean Yacht <br />SMI, LLC dated August 8, 2019 and recorded in the Portsmouth <br />Circuit Court Clerk's Office as Instrument Number 190008003. <br />3. That the subject property shall be subject to the following conditions as <br />proffered by the applicant for rezoning and owner of the property: <br />(a) All operations that cause noise, dust, or other nuisance type <br />activities will be ceased just before and during events at the <br />Atlantic Union Bank Pavilion. <br />(b) The ceasing of activities as stated in subsection (a) will be <br />coordinated with the City of Portsmouth and its designated <br />departments or personnel as directed and required by the City. <br />(c) The uses listed on Appendix A shall be prohibited on the property. <br />
