ZONING AMENDMENT ORDINANCE Z -20 -03 <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br />1. That the portion of the zoning map attached to and made a part of the City <br />of Portsmouth Zoning Ordinance, which now zones as GMU -K, General Mixed Use <br />(Conditional) the property described in Petition for Zoning Amendment Number Z -20- <br />03, is hereby amended and changed so as to show said property zoned as MU -H, High <br />Intensity Mixed Use, and that said property is hereby zoned as MU -H, High Intensity <br />Mixed Use. <br />2. That the property affected by this ordinance by being zoned from GMtT -K. <br />General Mixed Use (Conditional) to MU -H, High Intensity Mixed Use is furthermore <br />described as follows: <br />Z -20 -03 <br />5601 High Street <br />(Tax Parcel 0814 -0010) <br />ALL THAT certain lot, piece or parcel of land, with the <br />appurtenances thereunto belonging, situate, lying and being in the <br />City of Portsmouth, Virginia, being Parcel 5 -B as shown on that <br />certain plat entitled "SUBDIVISION OF PARCEL 5 PROPERTY <br />OWNED BY STERLING CREEK COMMONS LIMITED <br />PARTNERSHIP" a copy of which is recorded in Plat Book 17, <br />page 102 in the Clerk's Office, Circuit Court, City of Portsmouth, <br />Virginia. <br />IT BEING the same property conveyed to Victory Sterling Creek <br />Commons, LLC by Deed of Bargain and Sale from Portsmouth, <br />LLC and Pocahontas, LLC dated September 22, 2010 and recorded <br />in the Portsmouth Circuit Court Clerk's Office as Instrument <br />Number 100011167. <br />3. That the portion of the zoning map attached to and made part of the City <br />of Portsmouth Zoning Ordinance, which now zones as GMU, General Mixed Use the <br />property described in Petition for Zoning Amendment Number Z- 20 -03, is hereby <br />amended and changed so as to show said property zoned as UR -H, Urban Residential - <br />High, and that said property is hereby zoned as UR -H, Urban Residential -High. <br />4. That the property affected by this ordinance by being zoned from GMU, <br />General Mixed Use to UR -H, Urban Residential -High is furthermore described as <br />follows: <br />Z -20 -03 <br />
