ORDINAR 2019 -98 <br />AN ORDINANCE TO AMEND AND REORDAIN ARTICLE I OF CHAPTER 32 OF <br />THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (2006), AS AMENDED, BY <br />ADDING A NEW SECTION 32 -30 TO CLARIFY THAT THE OFFERING AND USE OF <br />SHARED MOBILITY DEVICES FOR HIRE IS PROHIBITED EXCEPT IN <br />ACCORDANCE WITH THE CITY'S SHARED MOBILITY DEVICE PILOT <br />PROGRAM. <br />BE IT ORDAINED by the Council of the City of Portsmouth. Virginia: <br />1. That Article I of Chapter 32 of the Code of the City of Portsmouth, Virginia <br />(2006), as amended, is hereby amended and reordained by adding a new Section 32 -30 stating as <br />follows: <br />Sec. 32 -30. — Shared Mobility Devices for hire prohibited except in accordance with Pilot <br />Program <br />(a) Except as permitted by the City of Portsmouth Shared Mobility Device Pilot Program or <br />such other related program as may be authorized by city council from time to time, the offering <br />for use, or actual use, of shared mobility devices for hire such as motorized skateboards, e- <br />scooters, motorized scooters, motorized bicycles, electric power - assisted bicycles or the like on <br />city streets, sidewalks or other public ways is prohibited. <br />(b) The prohibition in subsection (a) applies only to shared mobility devices for hire and <br />does not apply to the use of personally -owned mobility devices. <br />2. That this ordinance shall take effect immediately on the date of its adoption. <br />ADOPTED by the Council of the City of Portsmouth.
