ORDINARM No 2019 -38 <br />AN ORDINANCE TO AMEND AND REORDAIN CHAPTER 22 OF THE CODE <br />OF THE CITY OF PORTSMOUTH, VIRGINIA (2006), AS AMENDED, BY <br />AMENDING SECTION 22 -755 (REPORT BY INVESTIGATING OFFICER) TO <br />REVISE THE MINIMUM DAMAGE THRESHOLD REQUIRING <br />PREPARATION OF A MOTOR VEHICLE ACCIDENT REPORT TO ACCORD <br />WITH SECTION 46.2 -373 OF THE CODE OF VIRGINIA. <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br />1. That Chapter 22 of the Code of the City of Portsmouth, Virginia (2006), as <br />amended, is hereby amended and reordained by amending subsection 22- 755(a) as <br />follows: <br />Sec. 22 -755. - Report by investigating officer. <br />(a) Every police officer who, in the course of duty, investigates a motor vehicle <br />accident resulting in injury to or death of any person or total property damage to <br />an apparent extent of $ ® the minimum amount stated in Code of Virginia <br />X46.2- 373(A) (as said subsection is amended restated or moved from time to <br />time ) or more, either at the time of and at the scene of the accident or thereafter <br />and elsewhere, by interviewing participants or witnesses shall, within 24 hours <br />after completing the investigation, forward a written report of the accident to the <br />police department and the state department of motor vehicles. Such report shall <br />include the name of the insurance carrier or of the insurance agent of the <br />automobile liability policy on each vehicle involved in such accident. <br />{Subsections 22- 755(b) — (d) are not hereby amended} <br />2. That this ordinance shall take effect immediately on the date of its <br />adoption. <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held <br />on June 11, 2019. <br />Teste: <br />City Clerk <br />
