The Applicant must also obtain a permit from the City ( "Permit ") in accordance with the Program, <br />these Regulations and any other conditions established by the City. No Applicant shall operate a <br />Shared Mobility Device program within Portsmouth except pursuant to and in compliance with its <br />Permit. <br />The Applicant must provide proof of insurance meeting the requirements of the Program and such <br />other documentation as the City may require. <br />The Applicant must make the following payments: <br />a. A non - refundable application fee of $5000 for a new, Permit or $2,500 for renewal of an <br />existing Permit, due at the time of application. No application will be considered complete <br />before this payment is remitted. <br />b. A non - refundable fee equivalent to $1 /day /permitted device for the length of the Pilot <br />Program is due at the time of Permit issuance to support the Program's management. <br />An Applicant who is issued a Permit is referred to herein as a "Permittee ". All Permittees shall be <br />required to comply with these Regulations, including any changes or amendments made by the <br />City during the course of the Pilot Program. <br />Permits are not assignable or transferable and shall be effective for one year from the date of <br />issuance unless sooner terminated as provided in Section VII (Revocation) or Section XI <br />(Effective Dates). <br />IV. Operating Regulations <br />a. Equipment Requirements <br />i. All Shared Mobility Devices must meet all applicable local, State and Federal safety <br />standards including without limitation the following: <br />a. Bicycles shall meet the safety standards outlines in Code of Federal Regulations <br />Title 16, Chapter 11, Subchapter C, Part 1512- Reyuireinents for Bicycles. In <br />addition all bicycles shall meet the standards established in Va. Code §46.2 -1015, <br />including for lighting during operation in darkness. <br />b. Electric bicycles under shall meet the definition of electric power - assisted bicycle <br />in Va. Code §46.2 -100. <br />c. E- scooters shall meet the definition of motorized foot- scooter in Va. Code §46.2- <br />100. <br />ii. Shared Mobility Devices shall have a top motor - powered speed not to exceed 15 mph. <br />iii. Shared Mobility Devices shall meet the safety standards in Va. Code X546.2 -1015 requiring <br />both headlight and tailgate. <br />2 <br />
