R -19 -34 <br />A RESOLUTION ESTABLISHING THE CITY OF PORTSMOUTH SHARED <br />MOBILITY DEVICE PILOT PROGRAM AND ADOPTING PROGRAM <br />REGULATIONS. <br />WHEREAS, during its 2019 session the Virginia General Assembly adopted <br />House Bill 2752, which provided that any locality desiring to regulate the offering and use <br />of shared mobility devices for hire must have adopted a shared mobility device pilot <br />program as of January 1, 2020; and <br />WHEREAS, shared mobility devices provide cost- effective, environmentally - <br />friendly and convenient travel options, and it is therefore desirable to have shared mobility <br />devices offered for hire in Portsmouth, and <br />WHEREAS, it is also desirable to regulate the hiring of shared mobility devices to <br />avoid cluttering streets and sidewalks, and to ensure that the devices are used and stored in <br />a safe manner that does not pose a threat to pedestrians or other vehicles; and <br />WHEREAS, the City has researched other shared mobility device pilot programs <br />adopted within the Commonwealth and has crafted proposed pilot program regulations for <br />Portsmouth; and <br />WHEREAS, the pilot program will commence on December 31, 2019 and continue <br />until terminated by City Council; and <br />WHEREAS, the program authorizes a maximum of 250 total shared mobility <br />devices, and not more than 125 shared mobility devices per licensed provider; and <br />WHEREAS, the program regulations establish the geographic area in which <br />devices may be used, safety regulations including a maximum speed limit, and device <br />parking and storage requirements; and <br />WHEREAS, the program regulations also grant the City Manager the authority to <br />make amendments from time to time to improve the program; <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia that it hereby establishes the City of Portsmouth Shared Mobility <br />Device Pilot Program (the "Program "); and <br />BE IT FURTHER RESOLVED that the regulations attached as Exhibit A are <br />hereby adopted as the initial Program regulations; and <br />BE IT FURTHER RESOLVED that the City Manager is authorized to take such <br />actions as are necessary or desirable to implement the Program. <br />
