rr�n�JVw�j�[ 2018 -29 AN ORDINANCE AMENDING ORDINANCE 1978 -133 TITLED "AN ORDINANCE CLOSING THE FOLLOWING STREET: A PORTION OF NEWPORT AVENUE" FOR THE PURPOSE OF CORRECTING A PATENT ERROR IN THE LEGAL DESCRIPTION INCLUDED IN SAID ORDINANCE. WHEREAS, on December 12, 1978 the Council of the City of Portsmouth, Virginia adopted Ordinance 1978 -133 which purported to close a portion of Newport Avenue located between High Street and King Street; and WHEREAS, the ordinance included a legal description of the closure area; and WHEREAS, the legal description encompassed the area directly east of Newport Avenue and did not encompass any portion of Newport Avenue itself, and WHEREAS, the legal description represents an obvious and patent error; and WHEREAS, after adoption of the closure ordinance in 1978, the area of Newport Avenue between High Street and King Street was physically closed and discontinued as a public street, and the area has been incorporated into larger parcels; and WHEREAS, the error in Ordinance 1978 -133 was recently discovered by a title company, and the owner of the properties into which the Newport Avenue area has been incorporated has requested that City Council take action to correct the prior ordinance; NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That the legal description in Ordinance 1978 -133 is hereby amended as follows, nunc pro tunc: NEWPORT AVENUE Beginning at the southwest intersection of High Street and Newport Avenue (each as existing in 1978) and from thence running east along the south side of High Street 60 feet, more or less, to the southeast intersection of High Street and Newport Avenue; thence south along the eastern line of Newport Avenue to the northeast intersection Newport Avenue and King Street (as existing in 1978); thence west along the northern line of King Street 60 feet, more or less, to the northwest intersection of Newport Avenue and King Street; thence north along the western line of Newport Avenue to the point of beginning. Less, save and except any portion of Meander Road (as existing in 1978).
