BEING a portion of the same property conveyed to 3600 Forest <br />Haven Lane, LLC by Deed of Bargain and Sale from Mark A. <br />Harriman and Christi A. Harriman, husband and wife, dated April <br />26, 2013 and recorded in the Portsmouth Circuit Court Clerk's <br />Office as Instrument Number 130005022. <br />3. That the subject property shall be subject to the following conditions as <br />proffered by the applicant for rezoning and owner of the property: <br />(a) The rezoning will not take effect until a survey is approved and <br />recorded which will combine the rezoned portion of Lot 4 (i.e. the <br />property described as rezoned in this ordinance) with the existing <br />automobile dealership standing in the name of Team Automotive, <br />LLC. <br />(b) The property owner shall extend the twenty foot (20') rear yard <br />buffer that exists on all residential lots that are contiguous to First <br />Team Toyota. <br />(c) All trees, east of the extended fencing, that exist today will remain <br />unless they are damaged by storm, disease or insects and become a <br />hazard to the surrounding property. <br />4. That this ordinance shall take effect on the date of its adoption. <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held <br />on August 22, 2018. <br />Teste: <br />City Clerk <br />
