street on which the blighting influence exists and shall commence the process <br />to abate the criminal blight set forth in article V hereof . fde 4e - � <br />t4notable. aeeoptablo to the, dire, F- or- his b <br />plan stlbnqitted ilk Lli tillitl•1044.• 1 4 d by dt thr-n,.gl., Owe, . f eit-, staff O—_ —PO 4.- ....a.- <br />ARTICLE V. — REN410- V-4-1— OR Peep n i OF 1316H T NGS OR lITLTTn C TnT T/ TT inLC <br />=r�br�Y" r 'A f ABATEMENT OF CRIMINAL BLIGHT <br />ON REAL PROPERTY <br />Sec. 23 -90. — Prohibition of criminal blight: Aeclaration of nuisance: abatement generlly <br />a. <br />(al-Any criminal blight is hereby declared to be detrimental to the public health <br />and safety and a public nuisance and shall be removed from real Property or <br />the activity or policies or practices causing or enabling the blighting <br />influence discontinued or modified whenever it is nec_essary to do so in order <br />to effective)1_the nuisance. <br />In addition to enforcement procedures established elsewhere the city may <br />require the owner of real property to undert ake corrective action or the city <br />may undertake corrective action with respect to suchhrropert v in accordance <br />with the procedures established in this article V. <br />�_ A criminal blight�roceedi� ursuant to this article V�lo the extent filed <br />with a court of law shall be a civil proceeding <br />in a court of competent <br />Jurisdiction in the Commonwealth of Virginia. <br />Sec. 23 -91. — Affidavit and notice requirements. <br />a To initiate an enforcement action under this article. the city manager or her <br />designee shall execute an affidavit citing Code of Virginia S 15.2-907, to-the <br />effect that (i) criminal blight as defined in section 23 -1 of this chanter exists <br />on the property and in the manner described therein (ii) the city has used <br />diligence without effect to abate the criminal bli ht: and iii) the criminal <br />blight constitutes a present threat to the public's health safety, or welfare <br />gbh. The city manager or her designee shall then send a notice to the owner of the <br />property, to be sent by (i) certified mail return receipt rNuested; (ii1 Hand <br />delivery or (iii) overnight delivery by a commercial service or the United <br />States Postal Service, to the last address listed for the owner on the city's <br />
