2. That Portsmouth Redevelopment and Housing Authority is hereby granted a use permit pursuant to Section 40.1- 2.3(B) of the Code of the City of Portsmouth, Virginia (2006) for the construction of multi - family housing at 1 Lexington Drive, Portsmouth, Virginia, said property being more particularly described as: UP -17 -11 1 Lexington Drive (Tax Parcel 0145 -0010) ALL THOSE CERTAIN lots, pieces or parcels of land, being, lying and situate in the City of Portsmouth, Virginia, known as the Lincoln Park public 'housing community property and generally described as follows: COMMENCING at the northeast intersection of Deep Creek Boulevard and Graham Street; thence northeasterly along the northern line of Deep Creek Boulevard to the northwest intersection of Deep Creek Boulevard and Columbus Avenue; thence northwesterly along the western line of Columbus Avenue, inclusive of the closed right of way formerly known as Lexington Drive, to the southeastern corner of the Dale Homes public housing community (2300 Columbus Avenue, Tax Parcel 0167- 0040); thence westerly along the southern line of the Dale Homes public housing community to the northeastern terminus of Graham Street; thence southeasterly along the eastern line of Graham Street to the northeast intersection of Deep Creek Boulevard and Graham Street, the point of beginning. BEING the Lincoln Park public housing community property. 3. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) The development of the site shall be in substantial conformity with the concept plan titled "Development of Lincoln Park ", prepared by Saunders & Crouse Architects and dated October 20, 2017, which was submitted with the use permit application and is on file with the Department of Planning, except as may be necessary to comply with any modifications
