(h) Complies with all other city, state, and federal laws and regulations. <br />2. That The Woda Group, Inc. is hereby granted a use permit pursuant to <br />Section 40.1- 2.3(B) of the Code of the City of Portsmouth, Virginia (2006) to develop <br />and operate a mixed use development consisting of commercial space and not more than <br />59 units of multifamily housing (together with associated facilities and amenities) at 818 <br />County Street, Portsmouth, Virginia, being more particularly described as: <br />UP -17 -16 <br />818 County Street <br />(Tax Parcel 0049 -0270) <br />ALL THAT certain lot, piece or parcel of land, with the <br />buildings and improvements thereon, situate, lying and <br />being in the City of Portsmouth, Virginia, and labeled <br />"Disposition Parcel 191" on that certain plat titled <br />"Resubdivision of Disposition Parcel 191 /Crawford Urban <br />Renewal Project /for Portsmouth Redevelopment and <br />Housing Authority" prepared by Hoggard /Eure Associates, <br />P.C., dated July 30, 2002, and recorded in the Portsmouth <br />Circuit Court Clerk's Office in Map Book 19 at Page 60. <br />The said parcel is generally described as bounded by <br />Chestnut Street on the west, King Street on the north, <br />Effingham Street on the east, and County Street on the <br />south. <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The development of the site shall be in substantial conformity with the <br />concept plan labeled 818 County Street prepared by D. E. Weatherby & <br />Associates dated September 19, 2017 submitted with the application and <br />on file in the Department of Planning, except as may be necessary to <br />comply with any modifications required by City Ordinances and the City <br />Code during site plan review and approval. <br />(b) The design and materials of buildings constructed shall be in substantial <br />conformity with the "Exterior Elevations" dated September 19, 2017 and <br />revised on October 13, 2017 prepared by D. E. Weatherby & Associates <br />and on file in the Department of Planning. <br />(c) The site and building design and construction shall comply with at least 4 <br />of the Green Building features identified as "Schedule B" in Table 40.1 - <br />5.8(F), Green Building Bonuses, of the Zoning Ordinance. <br />
