Any permit granted under this section shall be subject to the following conditions: <br />al The permittee shall be solely responsible for all costs pertaining to the installation, <br />placement, maintenance, replacement or removal of the wireless facility on or from the <br />city facility: <br />b) The permittee shall be responsible for repairing all damage to the city facility resulting <br />from the installation, placement, maintenance, replacement or removal of the wireless <br />facility on or from the city facility, or for paving the cost incurred by the city to repair <br />the city facility <br />(c) In addition to complying with the right -of -way permit requirements set forth in article <br />II of chapter 32, the permittee shall notify the city engineer prior to performing any <br />work on the installation, placement, maintenance, replacement or removal of wireless <br />facilities on or from city facilities <br />(d) Prior to authorizing the commencement of work for the co- location, the city engineer <br />may require the permittee to provide a bond securing the cost of completion of the co- <br />location and the permittee's obligations under this section 32 -346 and section 32 -347• <br />(e) The issuance of a permit for the co- location of a wireless facility on a city facility does <br />not constitute a representation or warranty of the fitness of the city facility for the use <br />intended by the co- location* <br />(fl The city reserves the right to remove any city facility at any time for the protection of <br />the public health, safety or welfare, with or without notice to the owner of the co- <br />located wireless facilities, and the city shall have no liability for any such removal- and <br />Such other conditions as the city may reasonably require. <br />Sec. 32 -347. — Construction of new city facility. <br />If as part of the permitted co- location the applicant intends to construct a new city facility <br />whether to replace an existing city facility or otherwise. then (1) the new city facility shall be <br />constructed in strict accordance with plans and specifications approved by the city engineer, (2) <br />the applicant shall not commence to install the wireless facility onto the new city facility until the <br />city engineer has inspected and accepted the new city facility. and (3) the applicant shall execute <br />such documents or instruments as the city may require to confirm city ownership of the new city <br />facility <br />WE PUBLIC V4,Y <br />Sec, 32 -360. — Applicability. <br />A -11 <br />
