EXHIBIT A <br />1. Article II of Chapter 32 of the Code of the City of Portsmouth, Virginia (2006) is <br />amended by amending Subsection 32- 58(a), as follows. Section 32 -58 is not otherwise <br />amended. <br />Sec. 32 -58. - Permit required; exceptions. <br />(a) It shall be unlawful for any person to dig up, break, excavate, tunnel, undermine, <br />obstruct or in any manner disturb the surface or subsurface of any street, lane, alley <br />or public right -of -way in the city, or to perform work within or on the public right- <br />of-way or on structures located within or on the public right -of -way which <br />reasonably requires the implementation of traffic control or similar measures for the <br />safety of workers and the general publi c. without first having obtained from the city <br />engineer a permit to do so, except as otherwise provided for herein; nor shall such <br />work be performed after such permit shall have been revoked or shall have become <br />ineffective. All work shall be performed in accordance with the City of Portsmouth <br />Standards and the City of Portsmouth "Engineering Standards for Work in the Right - <br />of- Way." <br />2. Article IV of Chapter 32 of the Code of the City of Portsmouth, Virginia (2006) is <br />amended by amending Sections 32 -127, 32 -128, 32 -129, 32 -131, and 32 -132, and by <br />adopting new sections 32 -135, 32 -136, and 32 -137, as follows: <br />Sec. 32 -127. — Permit and franchise or encroachment permit required. <br />No person shall erect a post or a pole in any of the city's streets or rights -of -way <br />unless he first obtains lea franchise or encroachment permit and (2) a permit therefor <br />from the city engineer as required by section 32 -58. <br />Sec. 32 -128. - Plan of location and other materials to accompany permit application. <br />Any application for a permit to erect poles on the streets shall be accompanied by the <br />following materials: <br />aka plan indicating the proposed location of the same, subject to the approval of the <br />city engineer:} <br />b) the diameter of such pole at the butt; <br />(c) the minimum depth to which such pole is to be set or pole base design as applicable; <br />d) the height of such pole above the surface of the street <br />(e) the service for which such pole is to be used; and <br />
