construct a three dwelling unit residential development at 601 Jamestown Avenue, <br />Portsmouth, Virginia, being more particularly described as: <br />UP-16-09 <br />601 Jamestown Avenue <br />(Tax Parce10169-0400) <br />ALL THAT certain lot, piece or parcel of land, with <br />the buildings and improvements thereon, situate, <br />lying and being in the City of Portsmouth, Virginia <br />and being known, numbered and designated as Lot <br />A, as shown on that certain plat entitled <br />"Resubdivision of 2 Lots on Plat 3 Jane Cassells <br />Estate, Located Between Scotts Creek and Sixth <br />Street (M.B. 1, PG. 41), which said plat is duly <br />recorded in the Clerk's Office of the Circuit Court of <br />the City of Portsmouth, Virginia, in Map Book 24, at <br />page 107. <br />BEING the same real estate conveyed to Will <br />Washington Construction, LLC, by deed from Gary <br />S. Muhammad, dated May 26, 2016 and recorded in <br />the Portsmouth Circuit Court Clerk's Office as <br />Instrument Number 160005221. <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The development of the site shall be in substantial conformity with those <br />certain plans and elevations labeled "Proposed Front Elevations", <br />"Proposed Floor Plan" , "Proposed Rear Elevation", "Proposed Left <br />Elevation", and "Proposed Right Elevation", which were submitted as part <br />of the Use Permit application and appended to the Planning Commission <br />staff report, except as may be necessary to comply with any modifications <br />required by City Ordinances and the City Code during site plan review and <br />approval, and further except: <br />(i) Two large canopy trees shall be planted in the rear yard, in <br />accordance with the requirements of Part 506 of the D2 Form <br />Based Code ("D2 FBC"); <br />(ii) The building materials shall be listed and shown on the proposed <br />elevations for the Site-Plan Review Process, and shall be in <br />accordance with all applicable requirements of the D2 FBC; <br />
