The following words. terms and phrases when used in this Division 5 shall have the <br />meanings ascribed to them in this section• <br />Immediate family means a spouse children parents hro_ t__he__r_c and c;cterc anr~ any <br />other person living in the same household as the employee <br />Official responsibility means administrative or operating authority whether <br />intermediate or final. to initiate approve disapprove or otherwise affect a procurement <br />transaction. or any claim resulting therefrom. <br />Pecuniary interest arising from the procurement means a personal interest in a <br />contract as defined in the State and Local Government Conflict of Interests Act (Virginia <br />Code. & 2.2-3100 et sea.. as amended. restated or moved from tame t~ t;mel <br />Procurement transaction means all functions that pertain to the obtaining of any <br />goods. services or .construction. including description of requirements selection and <br />solicitation of sources. preparation and award of contract and all phases of contract <br />administration. <br />Public emnlovee means anv person emnloved by a public body including elected <br />officials or appointed members of ~overnin~ bodies. <br />33. Anew section, designated Section 12-282, is added to the Code of the City of <br />Portsmouth, Virginia (2006) as follows: <br />Sec 12-282 -Pro cribed narticiuation by public employees in nrncurempnt <br />transactions. <br />Except as maybe specifically allowed by subdivisions A 2 A 3 and A 4 of Code of <br />Virginia. & 2.2-3112. as amended restated or moved from time to time no public <br />emnlovee having official responsibility for a procurement transaction shall participate in <br />that transaction on behalf of the public body when the emnlovee knows that• <br />(11 The employee is contemporaneously emnloved by a bidder offeror or <br />contractor involved in the procurement transaction• <br />(21 The employee. the employee's partner. or anv member of the employee's <br />immediate family holds a position with a bidder. offeror or contractor such as an <br />officer, director trustee partner or the like or is emnloved in a capacity <br />involving personal and substantial participation in the procurement transaction <br />or owns or controls an interest of more than five percent• <br />25 <br />
