for public use involving the creation ofpublic-private partnerships shall be as adopted by <br />the city council on December 14, 2010, and set out in the document entitled "Public- <br />Private Education and Infrastructure Act of 2002 -Guidelines of the City of Portsmouth <br />(December, 2010)". A copy of said procedures shall be maintained on file for public <br />review and copying in the city purchasing office and also on the city's website. <br />30. Division 7. -Debarment of Article V of Chapter 12 of the Code of the City of <br />Portsmouth, Virginia (2006), which consists of Sections 12-291, 12-292, 12-293, 12-294, <br />and 12-295, is hereby moved, and the existing sections of Division 7 are hereby <br />renumbered to Sections 12-310, 12-311, 12-312, 12-313, and 12-314, and are further <br />amended as and to the extent set forth in pertinent part below: <br />DIVISION 7. -DEBARMENT <br />Sec. 12-31Q~. -Debarment authorized. <br />The purchasing administrator may, in his discretion and for the purposes of <br />protecting the integrity of the city's procurement process, debar a contractor for any of the <br />causes in section 12-311, using the procedures in section 12-312, and with the <br />right of appeal as set forth in section 12-313. <br />The purpose of debarment is to protect the city and its taxpayers from risks <br />associated with awarding contracts to persons or firms that have exhibited an inability or <br />unwillingness to fulfill contractual requirements, and to protect the integrity of the city's <br />procurement process by preventing individuals or firms who have displayed improper <br />conduct or unsatisfactory performance from participating in competition for city <br />contracts. <br />Prospective contractors may be debarred from contracting for particular-- <br />€R~}~PST4~'~-i3h}tkl t-~ t- -- Y---Y i~nrt 4n '41, t1. '~ a ~'~ OOd$ ~ <br />g 3 <br />services, insurance or construction for specified periods of time whether or not actually <br />bidding on a proposed contract at the time. Debarment of a contractors shall include any <br />other business entity with substantially the same principals or owners as a debarred <br />contractor. <br />Sec. 12-311. -Causes for debarment. <br />Sec. 12- 1~2~3. -Procedures for debarment. <br />(a) If the purchasing administrator concludes that there is cause under section 12-311 <br />for debarring a contractor, he may in his discretion debar the contractor using the <br />23 <br />
