discussion and revision of proposals and such revisions may be permitted after <br />submissions and prior to award for the purpose of obtaining the best and final offers. <br />In conducting discussions, evaluations. and necotiations there shall be no disclosure <br />of the identity of competing offerors or of any information derived from proposals <br />submitted by competing offerors. <br />(e) Awards shall be made to the responsible offeror or offerors whose proposal is <br />determined in writing to be the most advantageous to the city taking into <br />consideration price and the evaluation factors set forth in the request for proposals. <br />No other factors or criteria shall be used in the evaluation. The contract file shall <br />contain a statement in writing of the basis on which the award was made. <br />27. Section 12-277 of the Code of the City of Portsmouth, Virginia (2006) is amended <br />as follows: <br />Sec. 12-277. -Negotiation for insurance. <br />Upon a written determination made in advance by the city council that procurement <br />by competitive negotiation for professional services is either not practicable or fiscally <br />advantageous, insurance may be procured through a licensed agent or broker selected in <br />the manner provided for competitive negotiation as set forth in section 12-276. The basis <br />for this determination shall be documented in writing. <br />28. Section 12-278 of the Code of the City of Portsmouth, Virginia (2006) is amended <br />as follows: <br />Sec. 12-278. -Negotiation for professional services. <br />(a) Professional services shall be procured by competitive negotiation when the cost of <br />the professional services is expected to exceed $60,000.00. The purchasing <br />administrator and representative of the using department or agency shall engage in <br />individual discussions with two or morel offerors deemed fully qualified, <br />responsible and suitable on the basis of initial responses, with emphasis on <br />professional competence, to provide the required services. Repetitive informal <br />interviews shall be permissible. Such offerors shall be encouraged to elaborate on <br />their qualifications and performance data or staff expertise pertinent to the proposed <br />project, as well as alternative concepts. The request for proposals shall not, however, <br />request that offerors furnish estimates of man-hours or cost for services. At the <br />discussion stage, nonbinding estimates of total project cost, including, where <br />appropriate, ~~~~~--- ~~a life cycle costing and nonbinding estimates of <br />prices for services, may be discussed. Proprietary information from. competing <br />offerors shall not be disclosed to the public or to competitors.
