_ ,„ <br />AN ORDINANCE TO AMEND ARTICLE X OF CHAPTER 32 OF THE CODE <br />OF THE CITY OF PORTSMOUTH, VIRGINIA (2006) (FOOD AND ICE CREAM <br />TRUCKS) BY AMENDING SECTION 32-276 (DEFINITIONS) TO PERMIT <br />FOOD TRAILERS AND BY AMENDING SECTION 32-284 (OPERATING IN <br />THE DOWNTOWN AREA) TO AUTHORIZE THE CITY MANAGER TO <br />ESTABLISH REGULATIONS AND GUIDELINES GOVERNING THE <br />OPERATION OF FOOD TRUCKS IN THE VICINITY OF PORTSMOUTH <br />PAVILION ON DAYS WHEN CONCERTS ARE SCHEDULED. <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br />1. That Article X of Chapter 32 of the Code of the City of Portsmouth, <br />Virginia (2006) be amended and reordained by amending Section 32-276 as follows: <br />Sec. 32-276. -Definitions. <br />Food tYUCk means a food establishment that is located in or upon. or is nulled or <br />towed by aself-propelled vehicle licensed by the state department of motor vehicles, <br />containing a mobile kitchen, where food and non-alcoholic beverages are stored, <br />prepared, and served in individual portions to walk-up customers. <br />2. That Article X of Chapter 32 of the Code of the City of Portsmouth, <br />Virginia (2006) be amended and reordained by amending Section. 32-284 as follows: <br />Sec. 32-284. -Operating in the Downtown area. <br />(b) .Food trucks shall not o=~QO= ~r~ ..~.,~6~~a~~be allowed to <br />operate within 500 feet of any entrance to the Portsmouth Pavilion on <br />days when a concert is scheduled except in accordance with regulations and <br />guidelines established by the city manager in accordance with section 32-286 and <br />set forth in the food truck policies and procedures manual. In establishing <br />reQUlations and Quidelines._under this subsection. the city manager may consider the <br />cit 's interests in public safety. traffic control. the success of the Portsmouth <br />Pavilion as a regional entertainment venue. and such other factors as the city <br />manager deems necessary or appropriate. <br />3. That this ordinance shall take effect on the date of adoption. <br />
