~~~ 2015-14 <br />AN ORDINANCE TO AMEND CHAPTER 6 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) BY AMENDING SECTION 6-7 THEREOF <br />PERTAINING TO THE PROMULGATION OF RULES AND REGULATIONS <br />FOR THE OPERATION OF CITY-OWNED AND CITY OPERATED PIERS, <br />WHARVES, DOCKS, LANDINGS, AND OTHER WATER-DEPENDENT <br />FACILITIES. <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br />1. That Section 6-7 of the Code of the City of Portsmouth, Virginia (2006) is <br />hereby amended and reordained to read as follows: <br />Sec. 6-7. City piers, wharves, docks, landings, etc.; regulation. <br />(a) Definitions: <br />(1) High Street Inlet means that body of water located at the eastern end of <br />High Street. <br />(2) North Harbor means that body of water adjacent to the Elizabeth River <br />and bordered by Harbor Court, Bill Deal Street, and the Renaissance <br />Hotel. <br />(3) Portsmouth Seawall means that publicly-owned wall and walkway <br />beginning at the northeast corner of the South Inlet and the Southern <br />Branch of the Elizabeth River and running north to the end of the structure <br />approximately 2,880 feet along the west side of the Southern Branch of <br />the Elizabeth River. <br />(b) The following rules and regulations are established for vessels in the <br />North Harbor and the High Street Inlet and along the Portsmouth Seawall: <br />(1) No boater less than 18 years of age shall moor a vessel in the North <br />Harbor or the High Street Inlet. <br />(2) The mooring of recreational vessels in the Elizabeth River along the <br />Portsmouth Seawall is prohibited. <br />(3) Vessels shall tie up or moor only to the docks, not to other vessels. <br />"Rafting up" is not permitted. <br />(4) The anchoring of vessels is not permitted in the North Harbor or the High <br />Street Inlet unless the vessel is also tied up to the dock. <br />(5) No vessel shall be tied up or moored in the North Harbor or the High <br />Street Inlet for more than 36 continuous hours or a total of 72 hours within <br />any 30-day period. <br />(6) The mooring of vessels shall be on a first come, first serve basis, and no <br />spaces shall be "held" or reserved for vessels not actually present. <br />(7) Moored vessels shall not exceed 40 feet in length. The portion of the High <br />Street Inlet adjacent to the flagpole shall be utilized only by vessels 35-40 <br />feet in length. <br />(8) The discharge or pumping out of sanitary facilities into the North Harbor <br />or the High Street Inlet is strictly prohibited. <br />
