~~~ 2015-14 AN ORDINANCE TO AMEND CHAPTER 6 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (2006) BY AMENDING SECTION 6-7 THEREOF PERTAINING TO THE PROMULGATION OF RULES AND REGULATIONS FOR THE OPERATION OF CITY-OWNED AND CITY OPERATED PIERS, WHARVES, DOCKS, LANDINGS, AND OTHER WATER-DEPENDENT FACILITIES. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Section 6-7 of the Code of the City of Portsmouth, Virginia (2006) is hereby amended and reordained to read as follows: Sec. 6-7. City piers, wharves, docks, landings, etc.; regulation. (a) Definitions: (1) High Street Inlet means that body of water located at the eastern end of High Street. (2) North Harbor means that body of water adjacent to the Elizabeth River and bordered by Harbor Court, Bill Deal Street, and the Renaissance Hotel. (3) Portsmouth Seawall means that publicly-owned wall and walkway beginning at the northeast corner of the South Inlet and the Southern Branch of the Elizabeth River and running north to the end of the structure approximately 2,880 feet along the west side of the Southern Branch of the Elizabeth River. (b) The following rules and regulations are established for vessels in the North Harbor and the High Street Inlet and along the Portsmouth Seawall: (1) No boater less than 18 years of age shall moor a vessel in the North Harbor or the High Street Inlet. (2) The mooring of recreational vessels in the Elizabeth River along the Portsmouth Seawall is prohibited. (3) Vessels shall tie up or moor only to the docks, not to other vessels. "Rafting up" is not permitted. (4) The anchoring of vessels is not permitted in the North Harbor or the High Street Inlet unless the vessel is also tied up to the dock. (5) No vessel shall be tied up or moored in the North Harbor or the High Street Inlet for more than 36 continuous hours or a total of 72 hours within any 30-day period. (6) The mooring of vessels shall be on a first come, first serve basis, and no spaces shall be "held" or reserved for vessels not actually present. (7) Moored vessels shall not exceed 40 feet in length. The portion of the High Street Inlet adjacent to the flagpole shall be utilized only by vessels 35-40 feet in length. (8) The discharge or pumping out of sanitary facilities into the North Harbor or the High Street Inlet is strictly prohibited.
