(e) .There shall not be any flying of foods or other food preparation that <br />creates grease laden vapors, smoke, or moisture laden byproducts from the <br />cooking operation. Any change in the function of food preparation from a <br />warming kitchen will require commercial cooking appliances, commercial <br />range hoods, and fire suppression systems. Should the kitchen facilities be <br />improved as approved by the Building Official, this condition will no <br />longer apply, subject to any limitations imposed by the Building Official. <br />(f) The proposed development shall be required to provide a 10-foot wide <br />buffer of landscaping between the residential development to the east, <br />west and south and the City right-of--way to the north. <br />(g) The facility shall be operated in compliance with applicable codes, <br />ordinances and regulations of federal, state and local government, and all <br />required licenses and permits shall be obtained and remain in effect during <br />the operation of the facility. <br />(h) All taxes/fees associate with the property and/or the use shall be paid <br />when due. <br />(i) The owner/operator shall comply with Portsmouth City Code Sec. 24-255 <br />-Unlawful excessive sound (the Noise Ordinance) during site operations. <br />(j) Site activities shall preclude car washes and similar outdoor events. Site <br />activities shall be solely internal to the structure on the Property. <br />(k) If the Chief of Police, in his discretion, determines that there is a <br />significant risk to public safety or peace and good order then proceedings <br />to revoke the use permit may be initiated by the Director of Planning and <br />the use permit may be revoked. <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions <br />may serve as grounds for revocation of the use permit by City Council. <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held <br />on August 25, 2015. <br />Teste: <br />City Clerk <br />
