fraternal lodge at 21 Cavalier Boulevard, Portsmouth, Virginia, and being more <br />particularly described as: <br />UP-15-07 <br />21 Cavalier Boulevard <br />(Tax Parce10347-0630) <br />ALL THOSE certain lots of land, situate in the City <br />of Portsmouth, Virginia, and known, numbered and <br />designated as Lots Eleven (11) and Twelve (12) in <br />Block Four (4) as shown on a certain plat of property <br />belonging to U.A. Martin, known as Glendale, made <br />by F.S. Dey, Surveyor, dated March 14, 1898, and <br />duly recorded in the Clerk's Office of the Circuit <br />Court of the City of Chesapeake in Map Book 4 at <br />Page 58. <br />BEING that certain property conveyed to James W. <br />Whitehead, Sr. and James W. Whitehead, Jr. by <br />Deed of Gift from James W. Whitehead Sr. a/k/a <br />James W. Whitehead and Celestine Whitehead dated <br />February 14, 2007 and recorded in the Portsmouth <br />Circuit Court Clerk's Office as Instrument Number <br />070004272. <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The proposed development shall be in substantial compliance with the <br />plan entitled "Preliminary Site Plan for Tri-State Grand Council Lodge" <br />dated May 12, 2015, Portsmouth, Virginia, prepared by CAE, INC., <br />Engineers, Planners and Construction Consultants, Virginia Beach, <br />Virginia. <br />(b) The development plan shall be submitted for Site Plan Review, <br />administered through the Engineering Department, and shall address the <br />required parking area as well as the required landscaping buffers. <br />(c) The facility's operation shall be limited to Monday through Sunday no <br />earlier than 8:00 a.m. to no later than 10:00 p.m. <br />(d) The occupant load for the building shall be limited to 119 persons. The <br />occupant load for the upstairs shall be limited to 50 persons due to only <br />one stairway exit. <br />
