facility or land-disturbing activity. Areas channelward of mean low water shall not be considered <br />part of the site. <br />"State "means the Commonwealth of Virginia. <br />"State Board" means the Virginia State Water Control Board. <br />"State permit" means an approval to conduct aland-disturbing activity issued by the <br />State Board in the form of a state Stormwater individual permit or coverage issued under a state <br />general permit or an approval issued by the State Board for Stormwater discharges from a <br />Municipal Separate Storm Sewer System (MS4). Under these state permits, the Commonwealth <br />imposes and enforces requirements pursuant to the federal Clean Water Act and regulations, and <br />the Virginia Stormwater Management Act and attendant regulations. <br />"State Water Control Law" means Chapter 3.1 (§62.1-44.2 et seq.) of Title 62.1 of the <br />Code of Virginia. <br />"State waters "means all water, on the surface and under the ground, wholly or partially <br />within or bordering the Commonwealth or within its jurisdiction, including wetlands. <br />"Stormwater" means precipitation that is discharged across the land surface or through <br />conveyances to one or more waterways and that may include sormwater runoff, snow melt <br />runoff, and surface runoff and drainage. <br />"Stormwater Appeals Board " is the appeal authority designated by City Council to hear <br />appeals from any person aggrieved by a decision of the City in regard to Sormwater without a <br />formal hearing or by inaction of the City in regard to sormwater. The Board shall be appointed <br />by the City Manager and shall consist of three (3) members: the City Engineer,. the Assistant <br />Administrator of Public Utilities and the Administrator of Public Works. The City Attorney or <br />his designee shall serve a legal counsel to the Board. <br />"Stormwater management plan " means a document(s) containing material describing <br />methods for complying with the requirements of Section 31.2-6 of this ordinance. <br />"Stormwater Pollution Prevention Plan" or "SWPP" means a document that is prepared <br />in accordance with good engineering practices and that identifies potential sources of pollutants <br />that may reasonably be expected to affect the quality of Sormwater discharges from the <br />construction site, and otherwise meets the requirements of this ordinance. In addition, the <br />document shall identify and require the implementation of control measures, and shall include, <br />but not be limited to the inclusion of, or the incorporation by reference of, an approved erosion <br />and sediment control plan, an approved Sormwater management plan and a pollution prevention <br />plan. <br />
