minor general permit conditions, substantially increase or decrease the amount of surface water <br />impacts, increase the size of the operation, or reduce the capacity of the facility. to protect human <br />health or the environment. <br />"Nonresidential property" means all developed properties not meeting the residential <br />property definition herein including but not limited to, commercial properties, industrial <br />properties, parking lots, recreational and cultural facilities, hotels, offices, churches and <br />multifamily facilities of five units or more. <br />"Operator" means the owner or operator of any facility or activity subject to regulation <br />under this ordinance. <br />"Permit" or "VSMP Permit" means an approval to conduct aland-disturbing activity <br />issued by the Administrator for the initiation of aland-disturbing activity, in accordance with this <br />ordinance, and which may only be issued after evidence of general permit coverage has been <br />provided to the Department. <br />"Permittee"means the person to whom the VSMP Permit is issued. <br />"Person "means any individual, corporation, partnership, association, state, municipality, <br />commission, or political subdivision of a state, governmental body, including federal, state, or <br />local entity as applicable, any interstate body or any other legal entity. <br />"Process water" means water used in a commercial, industrial, manufacturing, or <br />processing operation and which comes in contact with materials used in that operation or with <br />the end product of the operation. <br />"Regulations" means the Virginia Stormwater Management Program (VSMP) Permit <br />Regulations, 9VAC-25-870, as amended. <br />"Residential property" means developed property containing at least one but no more <br />than four residences or dwelling units, and accessory uses related to but subordinate to the <br />purpose of providing a permanent dwelling facility. Such property shall include but not be <br />limited to houses, duplexes, triplexes, quadraplexes, townhouses, condominiums and mobile <br />homes. <br />"Semi pervious surface area" means surfaces such as gravel lots or compacted soil, on or <br />in a lot or parcel of property which substantially reduce the rate of infiltration of stormwater into <br />the earth. For purposes of the utility, semi-pervious areas will be counted at one-half the <br />measured area. <br />"Site " means the land or water area where any facility or land-disturbing activity is <br />physically located or conducted, including adjacent land used or preserved in connection with the <br />
