Layne Design Group, Engineers Surveyors Planners, is dated July 20, 2014, and was recorded in the Clerk's Office of the Circuit Court for the City of Portsmouth, Virginia in Map Book 23 at Pages 237 and 238. "Parcel B" means Parcel B as labeled on the Plat. "Parcel C" means Parcel C as labeled on the Plat. "Parcel D" means Parcel D as labeled on the Plat. (a) There shall be no residential uses permitted on the property or any portion thereof. (b) All excavation, land disturbance, and construction/development activities on the property shall be in full compliance with Section 11-41 through 49, Excavation Requirements for ABEX Superfund Site, of the Code of the City of Portsmouth, Virginia (2006). (c) An easement for ingress and egress across Parcel B to and from Parcel C and the Public Right of Way of Effingham Street shall be granted in substantially the area shown hatched on the Plat so that a means of ingress and egress is provided to Parcel C from Effingham Street. (d) An easement for ingress and egress across Parcel B to and from Parcel D and the Public Right of Way of Green Street shall be granted in substantially the area shown hatched on the Plat so that a means of ingress and egress is provided to Parcel D from Green Street. (e) A Traffic Impact Analysis shall be performed as required by the City Engineer and any required improvements will be incorporated into the development of or construction on Parcel C or Parcel D. No Certificate of Occupancy shall be issued for structures on Parcel C or Parcel D until the required improvements have been completed. (f) Any building constructed on Parcel B shall be in substantial conformance (including with respect to building design and construction materials) with Exhibit B ("Dollar General Portsmouth Virginia Drawn by John C. Hood, AIA 7/31/14") to applicant's Statement of Proffered Conditions dated July 29, 2014, except where modifications may be required to comply with the requirements of the City Code. 4. That this ordinance shall take effect on the date of its adoption.
