Layne Design Group, Engineers Surveyors Planners, is dated July 20, 2014, and was <br />recorded in the Clerk's Office of the Circuit Court for the City of Portsmouth, Virginia in <br />Map Book 23 at Pages 237 and 238. "Parcel B" means Parcel B as labeled on the Plat. <br />"Parcel C" means Parcel C as labeled on the Plat. "Parcel D" means Parcel D as labeled <br />on the Plat. <br />(a) There shall be no residential uses permitted on the property or any <br />portion thereof. <br />(b) All excavation, land disturbance, and construction/development <br />activities on the property shall be in full compliance with Section <br />11-41 through 49, Excavation Requirements for ABEX Superfund <br />Site, of the Code of the City of Portsmouth, Virginia (2006). <br />(c) An easement for ingress and egress across Parcel B to and from <br />Parcel C and the Public Right of Way of Effingham Street shall be <br />granted in substantially the area shown hatched on the Plat so that <br />a means of ingress and egress is provided to Parcel C from <br />Effingham Street. <br />(d) An easement for ingress and egress across Parcel B to and from <br />Parcel D and the Public Right of Way of Green Street shall be <br />granted in substantially the area shown hatched on the Plat so that <br />a means of ingress and egress is provided to Parcel D from Green <br />Street. <br />(e) A Traffic Impact Analysis shall be performed as required by the <br />City Engineer and any required improvements will be incorporated <br />into the development of or construction on Parcel C or Parcel D. <br />No Certificate of Occupancy shall be issued for structures on <br />Parcel C or Parcel D until the required improvements have been <br />completed. <br />(f) Any building constructed on Parcel B shall be in substantial <br />conformance (including with respect to building design and <br />construction materials) with Exhibit B ("Dollar General <br />Portsmouth Virginia Drawn by John C. Hood, AIA 7/31/14") to <br />applicant's Statement of Proffered Conditions dated July 29, 2014, <br />except where modifications may be required to comply with the <br />requirements of the City Code. <br />4. That this ordinance shall take effect on the date of its adoption. <br />
