<br />AN ORDINANCE TO AMEND CHAPTER 30 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) BY AMENDING SECTION 30-202 PERTAINING <br />TO THE RE-EMPLOYMENT OF RETIRED PUBLIC SAFETY EMPLOYEES. <br />BEIT ORDAINED by the Council of the City of Portsmouth, Virginia: <br />1. That Section 30-202 of the Code of the City of Portsmouth, Virginia (2006) is <br />hereby amended and reordained by the adoption of a new subsection (c) to read as follows: <br />Sec. 30-202. Period of membership; cessation of membership. <br />(c) The retirement allowance payable to any member who retires pursuant to the <br />provisions of Section 30-236(a) and who returns to police or fire employment after approval of <br />the Civil Service Commission shall not terminate upon re-employment. At the time of re- <br />employment, the member shall become a member of the Virginia Retirement System, subject to <br />the vesting and other requirements of that System. <br />2. That this ordinance shall be deemed to have taken effect on July 1, 2014. <br />ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held on <br />August 12, 2014. <br />Teste: <br />City Clerk <br />
