<br />2. That Verizon Wireless is hereby granted a use permit pursuant to Section 40.1- <br />2.3B of the Code of the City of Portsmouth, Virginia (2006) for the co location of a <br />telecommunications tower and supporting ground equipment at 1318 Spratley Street, and <br />being more particularly described as: <br /> <br />UP-13-05 <br /> <br />1318 Spratley Street <br /> <br />That parcel of property located northeast of the intersection <br />of Spratley Street and Scott's Creek and known as 1318 <br />Spratley Street. The property is more fully described in <br />Deed Book 1209, Page 0126 and is also identified as Tax <br />Map 46, Parcel 19. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The development of the site and subsequent installations of equipment <br />shall be in substantial conformity with the concept plans prepared by Clark Nexsen <br />Architects & Engineers and dated December 7, 2012, except as may be necessary to <br />comply with the conditions below and during site plan review and approval. <br /> <br />(b) Landscaping shall be installed to the west of the equipment shelter, as <br />approved by the Planning Director, to partially screen the shelter from view. <br /> <br />(c) The equipment shelter and all related equipment shall be elevated to an <br />elevation of9.1 feet in accordance with the City's Flood Protection Ordinance. <br /> <br />(d) All obsolete communications equipment that is no longer in use shall be <br />removed from the existing tower and site prior to application for and/or issuance of a <br />zoning compliance permit and building permit for the installation of the new antenna and <br />equipment shelter. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions <br />may serve as grounds for revocation of the use permit by the City Council. <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at meeting held <br />on June 25, 2013. <br /> <br />Teste: <br /> <br />City Clerk <br />
