'" R-12-20 A RESOLUTION MODIFYING THE CONDITIONS OF AN EXISTING USE PERMIT FOR BROAD STREET UNITED METHODIST CHURCH TO OPERATE A CHILD CARE CENTER AT 300 BROAD STREET. WHEREAS, the applicant, Broad Street United Methodist Church, was granted a use permit on February 24, 2004 by the Council of the City of Portsmouth, Virginia to operate a child care center subject to certain conditions; and WHEREAS, the applicant has requested a modification of certain of the conditions under which it is required to operate by the use permit; and WHEREAS, the Planning Commission has recommended approval of the modifications requested. NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that: 1. The application by Broad Street United Methodist Church (UP-12-03) to modify certain of the conditions under which it is required to operate its child care center is hereby granted. 2. operation: The following modified conditions shall apply to the child care (a) (b) The age range of the children shall be from newborn to 12 years of age. The facility shall be developed and operated in accordance with the submitted floor and site plan, as revised to allow for the summer and after school programs. 3. The following conditions imposed on the child care operation by City Council Resolution R-04-09 on February 24, 2004 shall remain in full force and effect: (a) The occupancy of the child care center shall not exceed 72 children at any one time. (b) Indoor hours of operation shall be limited to the hours between 6:30 a.m. to 6:00 p.m. Monday through Friday. (c) Outdoor play hours shall be limited to the hours between 8:00 a.m. and dusk Monday through Friday. (d) The outdoor play area shall be enclosed with fencing at least four feet in height. ( e) A minimum of 14 off-street parking spaces for the child care center shall be provided. (f) No on-street parking for drop-off/pick up of children associated with the child care center shall be permitted.
