<br />3. That the subject property shall be subject to the following conditions as <br />proffered by the applicant for rezoning, Cradock Properties, LLC: <br /> <br />(a) The property will be rezoned to Urban Residential-Master-Planned <br />Overlay UR-MPO and shall be used solely for the construction of up to 200 market rate, <br />for sale, single-family detached dwelling units. <br /> <br />(b) The development shall be designed and constructed in substantial <br />compliance with the conceptual master plan prepared by Hoggard-Eure Associates, P.C. <br />dated May 31, 2011 and titled "Conceptual Neighborhood Plan for Afton Green, <br />Portsmouth, Virginia." <br /> <br />(c) All development on the property, including the open space, shall be in <br />substantial compliance with the minimum design standards as contained within the <br />Development Guidelines, titled, "Afton Green, Development Guidelines, April 25, 2011, <br />revised May 31, 2011, Cradock Properties, L.L.C." <br /> <br />(d) All improvements recommended and required as part of the Traffic Impact <br />Assessment dated November 30, 2010, as approved by the City Engineer, whether on-site <br />or off-site, shall be designed and installed as part of the development at no cost to the <br />City. The improvements associated with the intersection of Afton Parkway and George <br />Washington Highway shall be constructed with the first phase of development. All other <br />improvements required by the Traffic Impact Assessment shall be constructed with the <br />second phase of development. <br /> <br />(e) All improvements and relocations recommended and required for the <br />provisions of public utilities, as outlined in the memorandum of understanding prepared <br />by Hoggard-Eure Associates dated April 11, 2011 and approved by the Department of <br />Public Utilities, whether on-site or off-site, shall be designed and installed as part of the <br />development at no cost to the City. The timing and phasing of said improvements shall <br />likewise be as determined by the Director of Public Utilities. <br /> <br />(f) All on-site improvements recommended and required for the provision of <br />stormwater management, as determined by the Drainage Study prepared during the <br />engineering design and as approved by the City of Portsmouth, shall be designed and <br />installed as part of the development at no cost to the City. The timing and phasing of said <br />improvements shall likewise be as approved by the City of Portsmouth. <br /> <br />(g) All homes within the subdivision shall be reviewed by an Architectural <br />Review Board for compliance with the Development Guidelines prior to submittal for <br />building permit. <br /> <br />(h) The Developer shall form a homeowner's association for the <br />development. The homeowner's association shall be responsible for the preservation and <br />maintenance of all common and open space within the development and other areas and <br />
