<br />ilRDlHANCE tJO_ 22:11-43 <br /> <br />AN ORDINANCE TO AMEND CHAPTER 35 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) BY AMENDING SECTION 35-6 THEREOF TO <br />ALLOW THE SALE OF REAL ESTATE WITH TAX DELINQUENCIES OF ONE <br />YEAR OR MORE. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That Section 35-6 of the Code of the City of Portsmouth, Virginia (2006) be <br />amended and reordained by the addition of a new subsection (c) to read as follows: <br /> <br />Sec. 35-6. Payment of delinquent real estate taxes first; disposition of monies tendered as <br />current tax payments; when land may be sold for delinquent taxes. <br /> <br />(c) The city treasurer may institute proceedings to sell in accordance with law any <br />real estate when any taxes on such real estate are delinquent on December 31 following the first <br />anniversary of the date on which such taxes have become due provided proper notice is given in <br />accordance with subsection A of Section 58.1-3965 of the Code of Virginia. <br /> <br />2. That the provisions of this ordinance shall take effect on the date of its adoption. <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held on June <br />28,2011. . <br /> <br />Teste: <br /> <br />City Clerk <br />
