<br /> <br />., <br />~ <br /> <br />City shall at all times comply with the American Railway Engineering and Maintenance of Way <br />Association (AREMA) Manual of Railway Engineering and shall in no case interfere with or <br />disrupt the use of the area hereby vacated and closed as a railroad right of way until the City and <br />the Virginia Port Authority have agreed to a time for such work to be performed. Permission for <br />the City or it's assignee to have use of the easement and in any case it shall not be unreasonably <br />withheld. In the instance of any unauthorized interference or disruption of the use of the area <br />hereby vacated and closed for railroad operations by any assignee of the City, then the Virginia <br />Port Authority or the railroad assigned rights to use the vacated and closed portion of Coast <br />Guard Boulevard shall look to the utility or political subdivision to whom such assignment was <br />made for compensation and/or relief. <br /> <br />BE IT FURTHER ORDAINED that the City Manager is hereby authorized to convey <br />any and all interest in said portions of Wyatt Drive and Coast Guard Boulevard as may have <br />vested in the City of Portsmouth by virtue of this vacation and closure to the owner(s) of <br />property lying adjacent thereto. <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held on <br />March 8, 2011. <br /> <br />Teste: <br />
