<br />uaUINANCE t1D.2 0 11~14.., <br /> <br />AN ORDINANCE CLOSING AND VACATING PORTIONS OF WYATT DRIVE AND <br />COAST GUARD BOULEVARD. <br /> <br />WHEREAS, the City of Portsmouth has requested the closure of portions of Wyatt Drive <br />and Coast Guard Boulevard as shown on Exhibit A, attached hereto and made a part hereof and <br />as hereafter described: <br /> <br />COAST GUARD BOULEVARD <br /> <br />All that certain portion of Coast Guard Boulevard lying between the south right of way <br />and limited access line of the Western Freeway, Virginia Route 164, Virginia Department of <br />Transportation Project 164-124-102, RW-203 and the south right of way line of the relocated <br />Coast Guard Boulevard and having approximately 100,522 S.F. or 2.3077 AC. It being more <br />. particularly described and shown on that exhibit entitled: "EXHIBIT SHOWING PORTIONS <br />OF COAST GUARD BOULEVARD AND WYATT DRIVE TO BE CLOSED AND <br />VACATED, PORTSMOUTH, VIRGINIA", and dated March 2, 2011, prepared by Patton Harris <br />Rust & Associates, Inc., which said exhibit is attached hereto and made a part hereof. <br /> <br />WYATT DRIVE <br /> <br />All that certain portion of Wyatt Drive lying on the east side of Coast Guard Boulevard <br />and the north side ofthe north right of way and limited access line of the Western Freeway, <br />Virginia Route 164, Virginia Department of Transportation Project 164-124-102, RW-203 and <br />having approximately 17,817 S.F. or 0.409 AC. It being more particularly described and shown <br />on that exhibit entitled: "EXHIBIT SHOWING PORTIONS OF COAST GUARD <br />BOULEVARD AND WYATT DRIVE TO BE CLOSED AND VACATED, PORTSMOUTH, <br />VIRGINIA", and dated march 2,2011, prepared by Patton Harris Rust & Associates, Inc., which <br />said exhibit is attached hereto and made a part hereof. <br /> <br />WHEREAS, the Planning Commission, at a meeting held on February 1,2011, <br />recommended approval of the closure and vacation of portions of Wyatt Drive and Coast Guard <br />Boulevard; and <br /> <br />WHEREAS, notice of the proposed closure and vacation has been given the adjoining <br />property owners in accordance with Section 15.2-2006 ofthe Code of Virginia, as amended. <br /> <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia that portions of Wyatt Drive and Coast Guard Boulevard be closed and vacated as <br />public streets and rights of way as shown on the Exhibit attached hereto. <br /> <br />BE IT FURTHER ORDAINED that the City of Portsmouth hereby reserves unto itself, <br />its successors and assigns in title, an easement for the construction, operation, maintenance and <br />repair of such utilities as the City may have or hereafter place within the area of Coast Guard <br />Boulevard hereby vacated and closed, and hereby reserves the full right and authority to assign to <br />any other utility or political subdivision of the Commonwealth of Virginia the use of the <br />easement hereby reserved.
