<br />"" <br /> <br />a CE ~JO.201~~~I~ <br /> <br />AN ORDINANCE TO AMEND CHAPTER 12 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) BY AMENDING SECTION 12-121 AND <br />APPENDIX A THEREOF TO PERMIT THE ASSESSMENT OF AN <br />ADDITIONAL COURT COST OF $3.00 IN CERTAIN CIVIL, CRIMINAL AND <br />TRAFFIC CASES TO BE APPLIED TO THE REPLACEMENT OF THE CITY <br />COURTHOUSES. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That Section 12-121 of the Code of the City of Portsmouth, Virginia <br />(2006) be amended and reordained to read as follows: <br /> <br />Sec. 12-121. Fee for the construction, renovation or maintenance ofthe courthouses, <br />jail or court-related facilities. <br /> <br />(a) There is hereby imposed for the construction, renovation or maintenance of <br />the courthouses or jail and court-related facilities an assessment in the amount as set forth <br />in appendix A to this Code, as part of the costs incident to civil, criminal or traffic cases <br />filed in the circuit court and district courts located within the boundaries of the city. The <br />assessment shall be collected by the clerk of the court in which the action is filed and <br />remitted to the treasurer. Disbursements shall be as authorized by the city council for the <br />construction, renovation or maintenance of courthouses or jail and court-related facilities <br />and to defray increases in the cost of heating, cooling, electricity and ordinary <br />maintenance. <br />(b) Upon certification by the Virginia Department of General Services that any <br />courthouse in the city is not in compliance with the safety and security guidelines <br />contained in the Virginia Courthouse Facility Guidelines, an additional fee as set out in <br />Appendix A shall be assessed as part of the costs in each civil action filed in the district <br />or circuit courts and in each criminal or traffic case in the district or circuit courts. Such <br />additional fee shall not be assessed in any civil action if the amount in controversy is <br />$500 or less. Any assessment so collected shall be expended solely for the construction, <br />reconstruction, renovation, or adaptive reuse of a structure to replace any courthouse so <br />certified as not in compliance. <br /> <br />(c) The assessment~ provided for in subsections (a) and (b) of this section are <br />in addition to the amount of clerk's fees or court costs already imposed or assessed for <br />traffic or criminal cases and shall be in addition to any other fees prescribed by law. <br /> <br />2. That Appendix A of the Code of the City of Portsmouth, Virginia (2006) <br />be amended to include the following: <br />
