<br />Sec. 33.1-21. Saving provision. <br /> <br />The adoption ofthis chapter shall not abate any pending action, liability or penalty of any person <br />accruing or about to accrue, nor waive any right of the city under any provision in effect prior to <br />the adoption of this chapter, unless expressly provided for in this chapter. Any subdivision plan <br />which has received preliminary approval prior to the adoption of this chapter and for which a <br />final plat is recorded within one year from the date of preliminary approval shall have vested <br />rights under the ordinance in effect at the date of preliminary approval. Failure to record a plat <br />within one year shall render the preliminary approval null and void. <br /> <br />Sec. 33.1-22. Definitions. <br /> <br />The following definitions shall apply in the interpretation and enforcement of this chapter. <br /> <br />Agent. The City of Portsmouth Director of Planning or his designee. <br /> <br />Alley. A minor way designed to give vehicular access to the side and rear of properties whose <br />principal frontage is on another street. <br /> <br />Approved. The word "approved" shall be considered to be followed by the words "or <br />disapproved," when the sense so requires. <br /> <br />Arterial streets. A street specifically designed to move high volumes of traffic from collector <br />streets through the city and not designed to serve abutting lots except indirectly through <br />intersecting streets. Arterial streets shall include all U.S. Highways, state primaries with one-, <br />two-, or three-digit numbers, state secondary roads with three-digit numbers, and any other street <br />which the Agent determines is functionally equivalent to these transportation department <br />classifications. This definition shall not include three-dig it-numbered streets which <br />are part of a recorded subdivision or an extension thereof. <br /> <br />Block. Land containing lots which are bounded by streets or a combination of conservation areas, <br />streets, public parks, cemeteries, railroads, rights-of-way, shorelines or boundaries of the city. <br /> <br />Building setback line. A line within a lot or parcel so designated on a recorded plat or as <br />otherwise established by the Code, and that defines the building envelope. <br /> <br />Building setback line, front. As defined by chapter 40. If the front property line is straight, the <br />building setback line is a line parallel to the front property line; if the front property line is <br />curved, the building setback line is a line parallel to any tangent of the front property line. <br /> <br />Commission. The City of Portsmouth Planning Commission. <br /> <br />Common open space. A parcel of land, an area of water, or a combination of land and water <br />within a site designed and intended primarily for the use or enjoyment of residents, occupants, <br />and owners within that development in which ownership is held in common with other owners of <br />that development. Common open space is not a buildable lot. <br /> <br />Condominium. A building, or group of buildings, in which units are owned individually, and the <br />structures, common area, and common facilities are owned by all the owners on a proportional, <br />undivided basis. <br /> <br />Page 6 of33 <br />
