<br />Sec. 33.1-16. Vacation of recorded plat. <br /> <br />Any recorded plat, or part thereof, may be vacated pursuant to section 15.2-2271 through section <br />15.2-2276 ofthe Code of Virginia, as amended. Any such vacation shall operate to destroy the <br />force and effect of the recording of the plat so vacated and to divest all public rights in, and to <br />reinvest to the owners, proprietors and trustee, if any, the title to the streets, alleys, easements for <br />public passage and other public areas laid out or described in such plat. <br /> <br />Sec. 33.1-17. Conformance to comprehensive plan. <br /> <br />A proposed subdivision shall conform generally to the requirements of the comprehensive plan of <br />the city. Substantial changes in land use as set forth in the comprehensive plan shall not be <br />permitted unless approved by the City Council, either by formal amendment to the plan or by <br />some other action such as granting a zoning change which implies approval of such proposed <br />change. <br /> <br />Sec. 33.1-18. Construction and severability of provisions. <br /> <br />This chapter shall be liberally construed so as to effectuate its purposes. If any clause, sentence, <br />paragraph, section or subsection of this chapter shall be adjudged by any court of competent <br />jurisdiction to be invalid for any reason, including a declaration that it is contrary to the <br />constitution of the Commonwealth or of the United States, or if the application thereof to any <br />government, agency, person or circumstance is held invalid, such judgment or holding shall be <br />confined in its operation to the clause, sentence, paragraph, section or subsection hereof, or the <br />specific application hereof, directly involved in the controversy in which the judgment or holding <br />shall have been rendered or made, and shall not in any way affect the validity of any other clause, <br />sentence, paragraph, section or subsection hereof, or affect the validity of the application thereof <br />to any other government, agency, person or circumstance. <br /> <br />Sec. 33.1-19. Private streets declaration. <br /> <br />If approved streets in a subdivision are not to be constructed to meet the standards necessary for <br />inclusion in the secondary system of state highways, or are not to be dedicated to the City of <br />Portsmouth, the subdivision plat and all deeds conveying lots in the subdivision, shall contain a <br />statement advising that the streets in the subdivision shall not be maintained by the transportation <br />department or the city, and where applicable, do not meet city and state design standards. <br /> <br />Sec. 33.1-20. Fees. <br /> <br />Fees, as identified in Appendix A of the City Code, shall be charged to offset the cost of <br />reviewing plats and plans, making inspections and other expenses incidental to the administration <br />ofthis chapter. <br /> <br />Page 5 of 33 <br />
