RmNANCE NO.201~9~ o . . __m--'. .~ AN ORDINANCE TO CLOSE A PORTION OF RUTTER STREET BEGINNING AT THE EASTERN LINE OF GODWIN STREET AND RUNNING EASTERLY 150 FEET, MORE OR LESS, TO ITS TERMINUS. WHEREAS, the City of Portsmouth and the Portsmouth Redevelopment and Housing Authority have requested the closure of a portion of Rutter Street east of Godwin Street as hereafter described; and WHEREAS, the Planning Commission, at a meeting held on November 2,2010, recommended approval of the closure and vacation of a portion of Rutter Street east of Godwin Street, and described as follows: A portion of Rutter Street beginning at the eastern line of Godwin Street and running easterly 150 feet, more or less, to its terminus. WHEREAS, notice of the proposed closure and vacation has been given the adjoining property owners in accordance with Section 15.2-2006 of the Code of Virginia, as amended. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Portsmouth, Virginia that Rutter Street beginning at the eastern line of Godwin Street and running 150 feet, more or less, to its terminus, be closed and vacated as a public street and right of way, all as more particularly shown on an exhibit entitled: "EXHIBIT "A" SHOWING POSSIBLE EXISTING STUB OF RUTTER STREET TO BE CLOSED PORTSMOUTH, VIRGINIA", a copy of which is attached hereto and made a part hereof. BE IT FURTHER ORDAINED that the City Manager is hereby authorized to convey any and all interest in said portion of Rutter Street as may have vested in the City of Portsmouth by virtue of this vacation and closure to the Portsmouth Redevelopment and Housing Authority, all in furtherance of the conveyances of property in the area between the City of Portsmouth and Portsmouth Redevelopment and Housing Authority authorized by City Council Resolution R-lO- 08 and evidenced by Deed of Bargain and Sale dated August 27, 2010 and recorded in the Circuit Court Clerk's Office as Instrument Number 100008635. BE IT FURTHER ORDAINED that this ordinance shall take effect on the date of its adoption. ADOPTED by the Council of the City pf Portsmouth, Virginia at a meeting held on December 14,2010. Teste:
