<br />ORDINANCE II. 201~75. <br /> <br />AN ORDINANCE TO AMEND CITY ORDINANCE NO. 2010-37 PERTAINING <br />TO RATES FOR WATER AND SEWAGE DISPOSAL SERVICES. <br /> <br />WHEREAS, City Ordinance No. 2010-37, adopted on May 11,2010, provided <br />that the increased rates for water and sewage disposal services would be applicable to all <br />bills rendered after July 1,2010; and <br /> <br />WHEREAS, City Council has determined that the increased rates should only be <br />applicable to water and sewage usage billed after July 1,2010. <br /> <br />NOW THEREFORE BE IT ORDAINED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That City public utility bills issued after July 1, 2010, that include water <br />usage and sewage disposal periods both prior to and after July 1,2010, shall prorate the <br />cost of such usage or disposal by multiplying metered water consumption by the rate in <br />effect during each period. For the purpose of making such calculations, consumption is <br />defined as the number of days in each water usage period times the average daily metered <br />water delivery to a premise during the billing cycle. The average daily metered water <br />delivery is defined as the total metered water consumption for the billing period divided <br />by the number of days in the billing period. <br /> <br />2. That City public utility customers shall be entitled to an account credit <br />equal to the amount of any overpayment resulting from this amendment of City <br />Ordinance No. 2010-37. <br /> <br />3. That this ordinance shall take effect on the date of its adoption. <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held <br />on September 14,2010. <br /> <br />Teste: <br /> <br />City Clerk <br />
