<br />ORDINANCE 11II.2010-62.;100 <br /> <br />AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA (2006) BY ADOPTING A NEW SECTION 22-18 THERETO AND BY <br />AMENDING SECTION 32-29 THEREOF PERTAINING TO SOLICITATION OF <br />CONTRIBUTIONS AND SALE OF MERCHANDISE OR SERVICES ON <br />PUBLIC STREETS. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. A new Section 22-18 to the Code of the City of Portsmouth, Virginia <br />(2006) is hereby adopted to read as follows: <br /> <br />Sec. 22-18. Distribution of handbills, etc., solicitation of contributions, and sale of <br />merchandise or services on highways, public roadways, and median prohibited. <br /> <br />(a) The following acts are prohibited: <br /> <br />(1) The distribution of handbills, leaflets, bulletins, literature, advertisements, <br />or similar materials to the occupants of motor vehicles on highways or on <br />public roadways and medians located within the city; <br />(2) The solicitation of any nature from the occupants of motor vehicles on <br />highways on public roadways and medians located within the city; or <br />(3) The sale of merchandise or services or the attempted sale of merchandise <br />or services to the occupants or motor vehicles on highways on public <br />roadways and medians located within the city. <br /> <br />(b) Any person violating the provisions of subsection (a) hereof shall be guilty <br />of a traffic infraction. <br /> <br />2. That Section 32-29 of the Code of the City of Portsmouth, Virginia (2006) <br />is hereby repealed. <br /> <br />Sec. 32-29. Live advertising prohibited in or near street right-of-way. <br /> <br />(a) No person shall stand within 15 feet of any right-of-way of any street, <br />and by means of his dress, or by making sounds, motions or gestures invite or draw the <br />attention or solicit the patronage or support of the public to any goods, merchandise, <br />property, real or personal, business, services, entertainment or amusement manufactured, <br />produced, bought, sold, conducted, furnished or dealt in by any person or for any political <br />party or for the candidacy of any individual for any nomination or office. <br /> <br />(b) Any violation of the provisions of subsection (a) shall be punishable by a <br />fine not to exceed $250. . <br />
