<br />'" <br /> <br />ORDINANCE 1IO~010-33 . <br />~_. <br /> <br />AN ORDINANCE AUTHORIZING THE CONVEYANCE OF CERTAIN PROPERTY <br />INTERESTS NEEDED FOR CONSTRUCTION OF AN ELECTRIC TRANSMISSION <br />AND DISTRIBUTION LINE OVER AND ACROSS PROPERTY OF THE CITY OF <br />PORTSMOUTH IN THE CITY OF SUFFOLK, VIRGINIA. <br /> <br />WHEREAS, Virginia Electric and Power Company ( VEPCO ) has determined that it is <br />necessary to construct a new electric transmission and distribution line from Carson, Virginia to <br />the City of Suffolk; and <br /> <br />WHEREAS, it is necessary that a portion of the line to be constructed across City of <br />Portsmouth property located in the City of Suffolk, which is used as watershed for the City's <br />reservoirs and lakes; and <br /> <br />WHEREAS, the new line will be built almost entirely adjacent to an existing line of <br />VEPCO which also crosses the City of Portsmouth property; and <br /> <br />WHEREAS, the new line will require certain real property interests, including certain <br />easements, in order for it to be built and to operate within the boundaries of the property of the <br />City of Portsmouth; and <br /> <br />WHEREAS, construction of the new line has begun west of the Tidewater area, and it is <br />imperative that the necessary property rights for the line be obtained as soon as possible. <br /> <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br />1. That the City Attorney shall determine what property interests are needed from the City <br />of Portsmouth in order for the line to be built and operated. In making that determination, the <br />City Attorney shall protect the interests of the City and shall retain such easements and/or <br />property rights as may be necessary for all reasonable present and future operational needs of <br />the City. <br /> <br />2. The City Attorney shall prepare a Cooperation Agreement with the Economic <br />Development Authority of the City of Portsmouth by which the City will convey said property <br />interests to the Authority for the purpose of having the Authority convey them to the VEPCO, in <br />accordance with Virginia law concerning property transfers by public entities. The terms of <br />conveyance shall require the grantee to pay fair compensation for said property interests. <br /> <br />3. The property interests authorized by this ordinance may include, as necessary fee <br />simple interests, permanent easements, temporary easements and licenses. <br />
