<br />EXHIBIT 1 <br /> <br />AGREEMENT FOR ANIMAL CONTROL SERVICES <br />(First renewal) <br /> <br />This agreement for Animal Control Services is made this _ day of June, 2010 by and <br /> <br />between the City ofPortsmoutli, Virginia (the "City") and the Portsmouth Humane Society, Inc., <br /> <br />a Virginia nonstock corporation (the "Humane Society"). <br /> <br />RECITALS <br /> <br />A. The Humane Society owns and operates a facility for housing and caring for animals <br /> <br />located at 2704 Frederick Boulevard, Portsmouth, Virginia (the "Facility"). <br /> <br />B. The City, through the Portsmouth Police Department, operates an Animal Control <br /> <br />Unit that has various responsibilities for dealing with animals, <br /> <br />C, The Animal Control Unit regularly takes custody of animals for various reasons, and <br /> <br />it must house and care for those animals while it has them in custody, <br /> <br />D. The Humane Society is capable of providing these custodial services at the Facility <br /> <br />for the City's Animal Control Unit, which would also serve as a Municipal Pound for this <br /> <br />purpose, <br /> <br />E, The City and the Humane City entered into an agreement dated June 25, 2009 to <br /> <br />arrange for these services to be provided by the Humane Society. By this instrument, the parties <br /> <br />extend the prior agreement, with certain adjustments. <br /> <br />WHEREFORE, in exchange for valuable and adequate mutual consideration, the receipt <br /> <br />of which is hereby acknowledged, the parties do hereby AGREE as follows: <br /> <br />AGREEMENT <br /> <br />-1- <br />
