<br />R-09-25 <br /> <br />A RESOLUTION GRANTING CONDITIONAL APPROVAL FOR CENTER FOR <br />EMERGENCY MEDICAL AND SAFETY TRAINING, A PRIVATE <br />EMERGENCY MEDICAL SERVICES AGENCY, TO PROVIDE CERTAIN <br />TRANSPORT SERVICES WITHIN THE CITY OF PORTSMOUTH. <br /> <br />WHEREAS, Virginia Code S 15.2-955 provides that no organization shall <br />provide emergency medical services without the prior approval by resolution of the local <br />governing body; and Virginia Administrative Code regulation 12V AC5-31-420 also <br />requires that any applicant for licensure by the Virginia Office of Emergency Medical <br />Services include such local approval in its state license application; and <br /> <br />WHEREAS, Center for Emergency Medical and Safety Training., a private <br />business (herein "Center"), desires a state license to provide certain medical transport <br />services in the City of Portsmouth, Virginia; and <br /> <br />WHEREAS, the Chief of the Portsmouth Department of Fire, Rescue and <br />Emergency Services (the "Fire Chief') has determined that Center has appropriate trained <br />staff and equipment to properly provide said services; now therefore <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. Approval to provide certain medical transport services is hereby granted to <br />Center for Emergency Medical and Safety Training, subject to the following mandatory <br />conditions while operating within the City of Portsmouth: <br /> <br />a. Center for Emergency Medical & Safety Training ("Center") shall limit its <br />transport business to non-emergency transports at all times when operating within <br />the City of Portsmouth. <br /> <br />b. Center may not attempt to provide service to, nor shall it respond to, <br />emergency situations (commonly known as "911 Calls") unless requested by an <br />authorized official of the Portsmouth Department of Fire, Rescue, and Emergency <br />Services (the "Department"), or through a written agreement with the Department. <br /> <br />c. If Center learns of an emergency situation while engaged in the normal <br />course of business, it shall promptly report same to the Dispatch Center operated <br />by the Department, and it shall thereafter follow all directives of the Department. <br /> <br />d. By accepting this approval, Center acknowledges and agrees that the <br />Department is the only designated 911 agency authorized to provide emergency <br />services and emergency transport. <br />
