<br />UP-08-12 <br />3706 Rapidan Street <br />3709-3711 Victory Boulevard <br /> <br />Beginning at a point in the western right of way line of <br />Victory Boulevard, said point being 335, feet more or less, <br />south of the point located at the intersection of the southern <br />line of Cavalier Boulevard and the western line of Victory <br />Boulevard, thence proceeding westwardly S 57001 '52" W <br />a distance of 300, more or less, feet to a point in the eastern <br />line of Rapidan Street, thence northwardly along the <br />eastern line of Rapidan Street a distance of 389 feet more <br />or less to the intersection of the eastern line of Rapidan <br />Street and the southern line of Cavilier Boulevard, thence <br />eastwardly along the southern line of Cavalier Boulevard to <br />its intersection with the western line of Victory Boulevard, <br />thence south along the western line of Victory Boulevard to <br />the point of beginning. <br /> <br />3. That the use permit for the operation of a food store with gas sales, an <br />eating place with seating, and a gasoline service station at 3709-3711 Victory Boulevard <br />and 3706 Rapidan Street, Portsmouth, Virginia is approved subject to the following <br />conditions which shall be observed by the applicant and any successor in interest: <br /> <br />(a) The land use is restricted to ten pump islands, a convenience store, and a <br />one-bay automatic car wash. <br /> <br />(b) The convenience store and gas station may operate 24 hours a day. The car <br />wash facility shall operate daily no earlier than 7 A. M. and no later than <br />11 P.M. <br /> <br />(c) Glazing equal to 50% of the wall space must be provided on all walls. <br /> <br />(d) The Department of General Services must approve the trash/garbage <br />collection system prior to final site plan approval. <br /> <br />(e) A minimum 15-ft. wide landscaping buffer containing a six foot high <br />wooden privacy fence and a combination of evergreen trees and shrubs, <br />and perennial flowers, plants and grasses that provides a solid screen to a <br />height of 20 feet within 5 years of planting shall be installed and <br />maintained along the Rapidan Street border. Comparable buffering shall <br />also be installed along the Victory and Cavalier Boulevards in accordance <br />to the submitted site plan. <br /> <br />(f) Freestanding signage shall be restricted to one monument style sign no <br />taller than 10 feet.
