<br />(f) As the current Applicant is a not-for-profit 501 (c) 3 tax-exempt Human <br />Services Organization, it is responsible to perform its fiduciary duty with <br />the best interests of its Charter, Mission and Objective. Under conditions <br />numbered (b) through (d) above, the City of Portsmouth, any Department, <br />Agency or affiliated entity thereof, shall not use their approval rights, <br />granted above in the form of approval of a Business Plan and lor <br />Operations Plan, to instruct, influence, require, or otherwise mandate the <br />Applicant provide, expand, reduce or eliminate any service, participate in <br />any endeavor, Committee, membership, or endorsement, nor require the <br />use of any personnel or service provider outside the scope of the <br />Applicant's submitted Business Plan and Operation Plan. In all instances, <br />the Applicant shall be permitted to operate freely within its Approved <br />Business Plan and Approved Operation Plan in compliance with all <br />applicable laws and regulations at a Federal, State and Local level. <br /> <br />(g) Approval of the final development must be obtained from the Downtown <br />Design Commission (DDC). <br /> <br />(h) Hours of operation shall be limited to 6:00 a.m. to 8:00 p.m., seven days a <br />week. <br /> <br />(i) Site Plan approval must be obtained. <br /> <br />(j) Bike racks for at least 25 bicycles shall be provided. <br /> <br />(k) A cul-de-sac or "T" type turnaround space must be provided at the <br />southern end of Williamsburg Avenue. <br /> <br />(1) A landscaping plan must be approved by the Director of Planning. <br /> <br />(m) An ingress/egress and utility easement along the entire east-west run of the <br />portion of Columbia Street shall be recorded and maintained. <br /> <br />(n) A utility/drainage easement 15 feet in width shall be recorded along the <br />western property line. <br /> <br />(0) Private trash hauler and pick up schedule must be approved by the <br />Director of Public Works <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council. <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at meeting held on <br />October 27,2009. <br />
